الملخــص: ارتبَطَ مصطَلَحُ الإعدام خارج الإطار القانوني من الناحية التاريخية باسم فرنسا الاستعمارية وممارساتها إبّان معْرَكَةِ الجزائر. ومن هذا المنطلق، يتناول هذا البحث مسألة عمليات الإعدام خارِجَ الإطار القانوني خلال معركة الجزائر، وذلِكَ بالتركيز على حالة اغتيال الشهيد محمد العربي بن مهيدي. ولِذلِكَ، تُحاوِلُ الدِّراسةُ معرِفَة الطّريقة التي تَمّت بها تصفيته. وقد تَوَصّل البحث إلى أنَّ أوساريس هو من أمرَ باغتيال بن مهيدي، وأنَّ اعترافاته التي سبقت وفاته بقليل كان لها أهمية قصوى في هذا الملف. Abstract: Historically speaking, the term of summary executions is associated with the French occupier and its practices during the battle of Algiers (1957). Building on these grounds, this paper discusses the question of summary executions during the battle of Algiers by focusing on the case of the assassination of Larbi BenM’hidi. Thus, this paper is an attempt to know how Larbi Ben M’hidi was assassinated. The study has shown that Aussaresses ordered the killing of Larbi Ben M’hidi, and that his confessions, little before his death, have had significant importance regarding this particular question.
