المسؤولية الجزائية لمسيري الشركات التجارية عن جرائم المضاربة غير المشروعة في التشريع الجزائري زمن الكورونا

الملخص
الملخص: نحاول من خلال هذه الدراسة التعرف على تصنيف جرائم المضاربة الغير مشروعة، ونخص فئة المسيرين في الشركات التجارية، وذلك بتحديد مواطن قيام المسؤولية الجزائية للمسير عن التجاوزات الماسة بمبدأ المنافسة والنظام العام للسوق، حيث عرفت هذه الجرائم تزايدا ملحوظا في ظل انتشار فيروس كورونا المستجد الذي خلف جملة من الآثار القانونية والاقتصادية عززت من ارتكابها لتحقيق أرباح غير مشروعة، وتلبية الحاجات المادية. وتنقسم جرائم المضاربة الغير مشروعة إلى صنفين، الأولى احتكارية، والثانية تقوم على الغش والاحتيال، حيث قرر المشرع الجزائري عقوبات جزائية صارمة ضد مرتكبيها حماية لمصلحة المستهلكين من جهة، ولتحقيق الردع من جهة أخرى. Abstract: This study aims to classify illegal speculative crimes committed by commercial companies' managers based on the areas and types of violations committed by managers in relation to the competition principle and the general order of the market. Using the descriptive and analytical approaches, several results were obtained, most notably that these crimes have witnessed a remarkable increase during the period of the COVID-19 spread which resulted in a number of legal and economic effects. These crimes were motivated by a desire to achieve unlawful profits and to meet the various financial needs. Illegal speculation crimes are divided into two types according to the nature of the criminal conduct, market monopoly and fraud, for which the Algerian legislator decided strict penal sanctions to protect the interests of consumers on the one hand and to achieve deterrence on the other hand. The manager as a natural person bears criminal responsibility instead of the company as a legal person whenever the crime is committed in his name and for his own account.
