الملخص
من العقود التي يمكن أن يتجسد من خلالها التفاوت بين أطرافه؛ العقد السياحي الذي يعتبر الإطار المنظم للمفاعيل القانونية المترتبة عن العملية السياحية، فنجد وكالات السياحة والأسفار تقوم بتنظيم رحلات سياحية من خلال برامج معدة مسبقا بفرض شروط على السائح الذي يكون في مركز يصعب معه مناقشة البنود كونه يمتاز بضعفه وجهله للمعلومات حول الخدمة التي يتعاقد عليها في المقابل نجد أن الأول في مركز اقتصادي قانوني معرفي متميز؛ وهو ما يضفي على العقد السياحي الطابع التنظيمي التعسفي. وبهذا يثير المركز القانوني للسائح العديد من المشاكل في وقت نجد أن المشرع الجزائري تدخل بتنظيم العقد السياحي بشكل محتشم، وأمام التبيان بين أطراف هذا العقد الذي يعتبر السائح في ظله مستهلك لخدمات سياحية قليل الخبرة، جاءت هذه الورقة البحثية، للكشف عن إمكانية تقرير حق السائح في العدول عن الرحلة السياحية الأمر الذي يجعله في مركز قانوني أفضل. كلمات مفتاحية: العدول عن العقد، العقد السياحي، السائح، وكالات السياحة والأسفار، الخدمات السياحية.
