الملخص
ملخص البحث بالعربية تميز الفكر الإصلاحي للشيخ محمد رشيد رضا باهتمامه بقضايا الواقع، ومشكلات العصر، ومعالجته معالجة واقعية منطقية من خلال أحكام الشرع ومقتضياته، تميزت معالجته برؤية حضارية متكاملة شملت الجانب الديني والتربوي والتشريعي والقانوني والسياسي… هذا المقال يسعى إلى بيان جانب من أهم جوانب المشروع الاصلاحي للشيخ رشيد رضا، وهو الجانب التشريعي القانوني الذي يعول على الاجتهاد لبناء مؤسسات الدولة القانونية والسياسية. ويهدف المقال إلى تتبع معالم المشروع التجديدي للشيخ في مجال إعمال الاجتهاد وتفعيل التشريع، وكشف منهجه، وبيان خصائصه، وتقويمه، وعلى أساس معالم هذا المشروع التجديدي يمكن البناء والإضافة والتطوير والتقويم. فالتشريع الاجتهادي في نظر الشيخ ضرورة لكل حضارة وعمران، فالمدنية تتوقف من حيث الرقي والتقدم والعمران، ومن حيث التنظيم والابداع على التنظيمات والتشريعات والقوانين التي تعكس هوية المجتمع وثقافته، إذ "لا يصلح لأمة من الأمم شرع أمة أخرى مخالفة لها في مقوماتها ومشخصاتها وتاريخها" ملخص البحث بالإنجليزية Research summary The Concept and Goals of Sheikh Rasheed Reda's Discretionary Legislation Sheikh Rasheed Reda's reformative thinking is distinguished by his interest in reality issues and age problems and his logical and realistic treatment through Sharīa provisions and requirements. This treatment was characterized by an integrated vision that included religious, legislative, legal, political and economic aspects. This article only seeks to clarify one aspect of Sheikh Rasheed's reformative project, the legal legislative one which relies on legislative endeavor to build legal and political state institutions. Indeed, discretionary legislation according to Sheikh Rasheed Reda is a necessity for every civilization and urbanism. In fact, civism in terms of advancement, development, urbanism, organization and creativity relies on legislations and laws that reflect the identity and culture of society as "an Umma' law is not suitable for another with different constituents, specifications and history." This article also aims to track Sheikh Rasheed Reda's renovating project milestones in terms of its legal legislation, reveal its approach, explain its characteristics and evaluate it. Construction, addition, development and assessment are all possible on the basis of this renovating project milestones.
