دور المحافظ العقاري في تفعيل الائتمان العقاري

الملخص
الحفظ العقاري إحدى الركائز الأساسية لتثبيت الملكية العقارية وحمايتها، لذلك تسعى كل الدول إلى تطوير نظامها العقاري وجعل عملية الشهر العيني الوسيلة الأهم لحماية وصيانة الثروة العقارية وتحقيق الأمن العقاري، فتوضيح القاعدة القانونية يحقق أمنا عقاريا. ومن أجل دراسة التحول الذي عرفه نظام الحفظ العقاري الإلكتروني وعصرنة نشاطه واعتماد المحافظات العقارية النموذجية، لا بد من معرفة السياسة العامة للدولة في ميدان تنظيم الملكية العقارية وتعزيز مبدأ الأمن القانوني ومدى فاعلية القرارات التي تصدر من المحافظ العقاري بشأن تنظيم الملكية العقارية. Summary Land registration is the cornerstone of establishment of land ownership and its protection, that is why countries are trying to develop their real estate tenure system and make the operation of real estate advertising the most important means to preserve and maintain land property and achieve land security, clarifying the legal basis achieves land security, and in order to study the change experienced by the electronic land registration system, the modernization of its activity and to adopt model real estate registration. It is essential to know the general policy of the estate in the field if the organization of land ownership and to support the principle of legal security, in addition to the degree of effectiveness of the decisions taken by the land registrar in the field of land organization.
