السلطات المستقلة في مجال الاعلام في القانون الجزائري والقانون الفرنسي، دراسة مقارنة

الملخص
ملخص: تعد السلطات المستقلة في مجال الإعلام إحدى ضمانات الحرية الإعلامية، وتتحقق استقلالية هذه السلطات من ناحيتين، الناحية العضوية أولا، أي تشكيلة هذه السلطات، ومن الناحية الوظيفية من جهة ثانية ، إي من ناحية حجم المهام الموكلة إليها ومدى الصلاحيات التي تتمتع بها. وقد عرف النظام القانوني الجزائري هذا النوع من السلطات في القانون رقم 90-07 المتعلق بالإعلام تحت تسمية المجلس الأعلى للإعلام، والقانون العضوي رقم 12-05 المتعلق بالإعلام تحت تسمية سلطات الضبط( سلطة ضبط الصحافة المكتوبة وسلطة ضبط النشاط السمعي البصري)، أما المشرع الفرنسي فقد عرف هذا النوع من السلطات تحت تسمية المجلس الأعلى للسمعي البصري. وعلى الرغم من ذلك فان هناك تباين بين النظامين القانونيين الجزائري والفرنسي لاسيما في مدى استقلالية تلك السلطات، ومن ثم تجسيد اكبر مساحة للحرية الإعلامية. لذلك ارتأينا من خلال هذا البحث أن نوضح مدى استقلالية هذا النوع من السلطات في القانون الجزائري مقارنة بالقانون الفرنسي، ومن ثم الوقوف على أي من النظامين يسعى إلى توفير اكبر قدر من الحرية الإعلامية. كلمات مفتاحية: الإعلام – السلطات المستقلة – الصحافة المكتوبة – السمعي البصري. Abstract: The independent authorities in the media field are one of the guarantees of media freedom, and the independence of these authorities is achieved in two respects, firstly in terms of membership, i.e. the composition of these authorities, and from the functional side on the other hand, i.e. the size of the tasks entrusted to them and the extent of the powers they have. The Algerian legal system has defined this type of authority in Law No. 90-07 related to media under the name of the Supreme Council of Information, and Organic Law No. 12-05 related to media under the name of the control authorities (the authority to control the written press and the authority to control audiovisual activity), while the French legislator This type of authority was known under the name of the Supreme Council of Audiovisual. Despite this, there is a difference between the Algerian and French legal systems, especially in the extent of the independence of these authorities, and thus the embodiment of the largest space for media freedom. Therefore, we wanted, through this research, to clarify the independence of this type of authority in Algerian law compared to French law, and then find out which of the two systems seeks to provide the greatest degree of media freedom.
