الحماية الجزائية لحرية ممارسة الحق النقابي

الملخص
لما كان الحق النقابي هو الحق الذي ينطوي على المطالبة العمالية بحقوقهم وايصال انشغالاتهم التي لم تعد محصورة في المطالب المادية البحتة وإنما تخطتها للمطالبة الاجتماعية بتحسين ظروف العمل والشغل بما يضمن الحياة الكريمة والعيش اللائق الذي يحمي كرامة العامل، والذي يسبب لممثلي النقابة الضغوطات والمشاكل مع أصحاب العمل كونهم الوسيلة التي يستعملها العمال لإيصال مطالبهم وانشغالاتهم. أرسى المشرع الجزائري العديد من الضمانات ورسائل الحماية التي تشكل إطار متكامل يمثل درع حماية لممثلي النقابات العمالية طيلة سريان علاقة عملهم بدءا من منع التمييز بينهم وبين العمال الآخرين في الأجور والمنافع الاجتماعية وعدم توقيع جزاءات تأديبية بسبب صفتهم التمثيلية، وحمايتهم من التسريح المقنع بسبب المطالبة العمالية، وتوج كل ذلك بتجريم هذه الأفعال بمخالفة عرقلة حرية الممارسة النقابية موقعا عليها عقوبات جزائية The right to a trade union is considered as a right which implies the claim by workers of their privileges and their concerns, which are no longer limited to purely material demands, but they exceeded them to a social demand for improving working conditions in such a way that guarantees a decent and respectful life that preserves the worker’s dignity. All of which causes pressure and problems, by the employers, to the union representatives since they are considered as a tool of pressure by which workers communicate their demands and concerns. Therefore, the Algerian legislator has established several guarantees and protection tools which form an integrated framework and a protective shield for the union representatives throughout their syndical service mainly by preventing any sort of discrimination between them and other workers in relation to their salary and benefits. Furthermore, union representatives are protected by low against disciplinary sanctions because of their syndical representativeness and from disguised dismissals due to the union demands. All of this has resulted in the criminalization of these illegal acts against the practice of union freedom while penalties have imposed.
