واقع المساعدات الإنسانية خلال النزاعات المسلحة في ظل تطبيق القانون الدولي الإنساني (سوريا أنموذجا)

الملخص
تشهد الساحة الدولية أبشع الجرائم ضد الإنسانية والمتمثلة في النزاعات المسلحة (الدولية وغير الدولية) في ظل معاناة الشعوب أمنيا واجتماعيا واقتصاديا، ولعل النزاع المسلح الدائر في سوريا هو أوضح أنموذج، وعليه يسعى القانون الدولي الإنساني للحدّ من تأثير هذه النزاعات من خلال آلية تقديم المساعدات الإنسانية والتي نصّت عليها اتفاقيات جنيف الأربعة لسنة 1949 بشأن حماية المدنيين في أوقات الحروب، إلاّ أنّ تنفيذ هذه الآلية أثناء النزاعات يعترضها الكثير من العقبات التي تقلّص من دورها، تهدف هذه الدراسة إلى تحليل واقع المساعدات الإنسانية والوقوف على التحديات التي تقف أمام لمنظمات المسؤولة عن تقديمها، اعتمادا على المنهج الوصفي التحليلي ومنهج دراسة حالة سوريا، لنستنتج أنّ تعدد أطراف النزاع المسلح في سوريا وتسييس المساعدات الإنسانية يحد ّمن العمل الإنساني . The international arena is witnessing the most heinous crimes against humanity, posed by armed conflicts (international and non-international), in light of the suffering of the people security, social and economic, maybe the armed Conflict in Syria is the clearest model, accordingly, international humanitarian law seeks to reduce the impact of these conflicts, through the humanitarian aid mechanism provided for by the Fourth Geneva Convention of 1949 on the protection of civilian in times of war, However, the execution of this of this mechanism during conflicts has been hampered by obstacles that reduce its role, The study aims to analyze the reality of humanitarian aid and the challenges faced by the organizations responsible for providing it, Based on the analytical descriptive approach and the Syria case study approach, Let's conclude that the multiplicity of parties to the armed conflict in Syria and the politicization of humanitarian aid limits humanitarian action.
