الشرح الأصولي - حقيقته وعوائده: دراسة تحليلية The Concept And Outcome Of Commentarial Usuli Works: An Analytical Study

الملخص
الملخص تسعى هذه الدراسة إلى بيان حقيقة الشرح الأصولي وفوائده، ورسم معالمه المحكمة من خلال المصنفات الأصولية. وقد سلكت الدراسة منهجاً استقرائياً تحليلياً تاريخياً؛ إذ انطلقت من تتبع الجزئيات ليستقرئ منها معالم ذلك النمط من الشرح، ثم عمدت إلى تتبع أطواره، ليبرز معالم كل طور مقرونةً بالاستنباط والتحليل. وقد خلصت الدراسة إلى أن الشرح الأصولي درس علمي أصولي دار حول كتاب أو نص أو فكرة. وموضوعه متن أصولي معين يتناول جميع المباحث الأصولية أو مبحثاً معيناً منها؛ وأن من فوائد هذا الشرح تعقب المتون الأصولية بالبيان والنقد، وتصوير المسائل الأصولية والاستدلال عليها، والاعتراض على الأدلة المسوقة للمذاهب، أو الجواب عن الاعتراضات الواردة عليها. كما استخلصت الدراسة أن ظاهرة الشروح كانت في غالبها ذات عوائد إيجابية؛ إذ ساهمت في تجديد علم أصول الفقه، إما بتصحيح ما ورد في مصنفاتهم، وتحرير محل نزاعهم ووفاقهم، أو تناول المسائل المطروحة سابقا بشكل مميز، أو اقتراح موضوعات رائقة ومفاهيم جديدة لتطرح لاحقاً على بساط التقعيد والتأليف. الكلمات المفتاحية: الشرح، المتن، أصول الفقه، منهج المتكلمين، منهج الفقهاء. Abstract: This study endeavors to define the phenomenon of authoring commentaries in the field of Usul Fiqh. It follows an inductive-analytical and historical approach to deduce the features of the Usuli commentary and then to trace its historical phases. The study concludes that the Usuli commentary is a scientific work revolving around a book, text, or an idea. The subject of a commentary is a specific text that deals with either entire or selected issues of Usul Fiqh. This scientific phenomenon could generate many advantages such as creating significant comments on the texts of Usul, clarifying the Usuli concepts, issues and evidences, criticizing the doctrines and neutralizing some of their disagreements. The Usuli commentaries had contributed to the renewal of the science of Usul al-Fiqh, either by correcting what was contained in its works and editing what the Usuli scholars had disputed, or dealing with the issues previously raised in a new and distinctive way, and proposing new topics and concepts to be further addressed in future writings.
