المرور غير البريء للسفن الحربية الأجنبية في البحر الإقليمي

الملخص
تهدف هذه الدراسة إلى تبيان المعيار العام لبراءة مرور السفن الحربية الأجنبية في البحار الإقليمية للدول الساحلية، إضافة إلى توضيح التصرفات النافية لبراءة مرور هذا النوع من السفن، من أجل تفادي اصطدام سيادتين على مسرح العلاقات الدولية: سيادة الدولة التي تحمل السفينة الحربية علمها وتتمتع بحصانتها وسيادة الدولة الساحلية التي تتواجد هذه الأخيرة في مياهها الإقليمية. وذلك يستوجب إحداث نوع من التوازن بين أعضاء المجتمع الدولي، ومن ثم السعي إلى التوفيق بين المصلحة الخاصة للدولة الساحلية والمصالح العامة للجماعة الدولية، ومن أجل تجنيب المجتمع الدولي الكثير من النزاعات، لأن المشاكل المتعلقة بالسفن الحربية بقيت حاضرة إلى يومنا هذا بفعل التسابق بين الدول. This study aims to clarify the general standard for the innocence of the passage of foreign warships in the territorial seas of the coastal states, in addition to clarifying the actions that deny the innocence of the passage of this type of ships, in order to avoid the collision of two sovereigns on the stage of international relations: the sovereignty of the state that carries its flag and enjoys its immunity and sovereignty The coastal state in whose territorial waters the latter is located . This necessitates creating a kind of balance between the members of the international community, and then seeking to reconcile the special interest of the coastal state with the general interests of the international community, and in order to spare the international community many conflicts, because the problems related to warships have remained present to this day due to competition between states.
