قراءة في القانون رقم 18-11 المتعلق بالصحة بين المستجدات والنقائص

الملخص
تتناول هذه الدراسة تحليل ومقارنة النصوص التشريعية الواردة في قانون الصحة رقم 18-11 بما كان عليه قانون حماية الصحة وترقيتها السابق، فغني عن البيان أن الأعمال الطبية الماسة بجسم الإنسان أثارت ولا تزال تثير جدلا قانونيا وطبيا، خاصة مع التقدم العلمي الذي يشهده العالم اليوم سواء على مستوى طبيعة العمل الطبي أو الوسائل المستخدمة للعلاج، من هنا يتدخل المشرع لتنظيم لمختلف هذه المستجدات، فتكون هذه الدراسة بمثابة تسليط الضوء على ما استحدثه المشرع الجزائري في قانون الصحة الجديد مع تسجيل النقائص التي لم يتناولها بالتقنين. This study deals with the analysis and comparison of the legislative texts contained in the Health Law No. 18-11 under the Health Protection and Promotion Act. It goes without saying that the medical work of the human body has aroused and continues to raise legal and medical controversy, especially with the scientific progress witnessed by the world today. In this regard, the legislator intervenes in organizing the various developments. This study will shed light on what the Algerian legislator introduced in the new health law, with the recording of the shortcomings that he did not address by rationing.
