الملخص
ملخص: إجراء الرأفة يعتبر كأداة للكشف عن الاتفاقات الأكثر ضررا على الاقتصاد، إذ يسمح لمجلس المنافسة من منح حصانة كاملة أو جزئية من العقوبات المالية للمؤسسة التي تساعد في إظهار حقيقة الاتفاق الغير مشروع التي شاركت فيه وتوفير العناصر والمعلومات للسلطات والتي لم تكن لديها مسبقا. ولكن الإعفاءات من العقوبة التي يمكن أن يمنحها مجلس المنافسة للمؤسسة في إطار الرأفة لا يضمن الإعفاء من العقوبة أمام القاضي. Résumé La clémence est un outil qui permet de découvrir les accords les plus dommageables pour l’économie et permet au Conseil de la concurrence d’accorder une immunité totale ou partielle aux sanctions pécuniaires de l’institution, ce qui permet de montrer la vérité de l’accord illégal auquel elle a participé et de fournir aux autorités des éléments et des informations dont elle n’avait pas l’avance. Toutefois, les exemptions de peine que le Conseil de la concurrence peut accorder à l’entreprise dans le cadre de programmes de clémence ne garantissent pas une exemption de la peine devant le juge. Abstract the clemency procedure is considered as a tool for detecting the most harmful agreements on the economy. This procedure allows the competition council to grant total or partial exemption from the financial sanction to the institution which contributes to establish the reality of an illegal agreement in which it participated, and provide elements and information to the authorities which it did not have in advance. However, exemptions from penalties that the competition council may grant to the foundation under clemency programs do not guarantee exemption from sanction before the judge.
