الاثبات في العقود الإدارية الإلكترونية أمام القضاء الإداري

الملخص
إن ثورة تكنولوجيا الاتصال والمعلومات كان لها الصدى العميق في تعديل وتطوير النصوص والمصطلحات القانونية في مختلف القوانين، وقد نتج عن هذه الثورة "العقود الالكترونية" التي يتم إبرامها عن بعد، بحيث تفاعل المشرع الجزائري إيجابا مع هذا النوع من العقود بالسماح للإدارة بالتعاقد عن طريق وسيلة النت، آخذا بعين الاعتبار الظروف الصعبة التي مرت بها الجزائر من خلال تفشي جرائم الفساد وعرقلة المشاريع التنموية، الأمر الذي دفع المشرع الجزائري للبحث عن آليات قانونية إلى تبنيه إستراتيجية جديدة، تمثلت في إقرار البعد الوقائي بتعزيز الدور الرقابي للقاضي الإداري أثناء مرحلة إبرام العقود الإدارية سواء التقليدية منها أو الالكترونية. Information and Communication Technologies revolution has had a deep impact in the amendment, and development of legal texts and terminology in a range of laws. Such a revolution resulted in "electronic contracts" that are concluded remotely which made the Algerian legislator interact positively with this type of contract, by allowing the administration to make contracts via the Internet; taking into account the difficult conditions Algeria went through during the spread of corruption crimes, and the hindrances the development projects faced. Effectively that prompted the Algerian legislator to search for legal mechanisms by adopting a new strategy represented in the validation of the preventive dimension that strengthens the supervisory role of the administrative judge during the stage of concluding administrative contracts comprising either traditional or electronic ones.
