الحماية الجزائية للتصريح بالممتلكات ما بين النص العقابي وتفعيله

الملخص
يشكل التصريح بالممتلكات إحدى الآليات الوقائية المنصوص عليها في القانون01/06 المتعلق بالوقاية من الفساد ومكافحته الرامية إلى ضمان الشفافية في الحياة السياسية والشؤون العمومية، وحماية الممتلكات العمومية، وصون نزاهة الأشخاص المكلفين بخدمة عمومية. ولأهمية هذه الآلية الوقائية قرر المشرع لأول مرة تجريم عدم التصريح أو التصريح الكاذب بالممتلكات وذلك في المادة 36 من القانون 01/06 رغبة منه في توفير ضمانة قوية لتفعيل التصريح بالممتلكات، إلا أن بلوغ هذا الهدف لا يتسنى بمجرد إيجاد النص العقابي بل يتطلب أن تتوفر فيه مقومات الدقة والوضوح في تحديد عناصر الجريمة وإمكانية متابعتها وإثباتها بشكل يسمح للقاضي الجزائي أن يطبقه على الوقائع المحالة عليه. ولمعرفة مدى توفر هذه المقومات في نص المادة 36 يرمي هذا المقال إلى إجراء قراءة تحليلية لأهم عناصر جريمة عدم التصريح والتصريح الكاذب بالممتلكات. Étant donnée l’importance de la déclaration de patrimoine en tant qu’instrument préventif de lutte contre la corruption, le législateur algérien a pour la première fois dans la loi 06/01 relative à la prévention et à la lutte contre la corruption érigé en infraction pénale le défaut et la fausse déclaration de patrimoine tel qu’il ressort de l’article 36 de cette loi. Cette consécration textuelle de la protection pénale de la déclaration de patrimoine ne suffit pas à elle seule à affirmer son efficacité sans une analyse détaillée de ce texte. La présente étude se propose de faire le point sur les éléments constitutifs de l’infraction au regard des conditions de précision et de clarté nécessaires à l’application de tous textes à caractère pénal. Given the importance of the declaration of properties as a preventive instrument for the fight against corruption the Algerian legislator has made in the law for the prevention and fight against corruption (law 06/01 of the 20th of February 2006)the not declaring and the false declaration of assets as an offense as it appears from article 36. This textual consecration of the declaration of assets penal protection is not enough to affirm the effectiveness of this text. This study proposes to clarify the constituent elements of the offense with regard to the conditions of precision and clarity necessary for the application of all penal texts.
