الملخص
قصد تعزيز دور الجمارك بشكل يجعل منها إدارات فاعلة في تسيير حركة التجارة لاسيما عبر الموانئ التي لطالما ميزتها أزمة الاختناق المرفئي، والتقليل من وتيرة المنازعات المينائية التي يرجع أغلبها إلى طول الإجراءات الجمركية، قامت المنظمة العالمية للجمارك سنة 2005 باقتراح مجموعة من المقاييس، أبرزها ما عُرف ب"مقاييس سايف" أي مقاييس السلامة، التي تضمنت أربعة محاور، لعل المحور الذي حاز أهمية معظم الدول هو محور "المتعامل الاقتصادي المعتمد"، الذي تبنته مختلف الدول بما فيها الجزائر وذلك سنة 2010، وضبطته سنة2012 من خلال المرسوم التنفيذي رقم 12-93 الذي حدد شروط الاستفادة من هذا النظام ابتداء من شروط ذات صلة بطالب الاستفادة مرورا بالإجراءات الواجب اتباعها قبل تسليم الملف لإدارة الجمارك قصد فحصه شكليا وموضوعيا وتقرر بالتالي قرار منحه الصفة من عدمه. وفي حال صدور القرار بالإيجاب، يستفيد المتعامل من مزايا عدة على رأسها إجراءات جمركية مبسطة وسهولة تحصيل بضاعته، الجمركة عن بعد والإعفاء من المراقبة، أما على المستوى الدولي فيستفيد من التبسيطات الممنوحة في الدول الأخرى في إطار ما يعرف ب"اتفاقات الاعتراف المتبادل". وفي مقابل ذلك يفرض عليه القانون مجموعة من الالتزامات أغلبها ذات طابع أخلاقي. Le résumé : Afin de renforcer le rôle des douanes en les rendant des administratives actives dans la circulation des marchandises, notamment dans les ports qui souffrent depuis toujours du phénomène de la congestion d’une part, et d’autre part, réduire le taux des contentieux portuaires, l’organisation mondiale des douanes OMD, a proposé en 2005, un ensemble de normes appelées « normes de safe », qui regroupent quatre axes, parmi lesquels le statut de l’opérateur économique agréé. Ce dernier, a remporté l’attention de la plupart des Etats y compris l’Algérie, qui l’a adopté en 2010, tout en l’organisant en 2012, par le biais du décret exécutif n° 12-93 qui fixe d’abords, les conditions d'acquérir la qualité de l’opérateur économique agréé, et ensuite, les procédures à suivre avant de remettre le dossier à l’administration de douanes pour qu’elle prend la décision de lui accorder la qualité ou non. Si sa décision était au profit du demandeur, il bénéficie de plusieurs avantages tels que la simplification des procédures douanières, traitement prioritaire des marchandises et un dédouanement à distance. Au niveau international, il bénéficiera des simplifications douanières accordées dans les autres Etats dans le cadre de ce qu’on appelle « les accords de reconnaissance mutuelle ». En revanche, le bénéficier est tenu d’exécuter certaines obligations, dont la plupart est de nature morale. Abstract : In order To strengthen the role of customs by making it an active administrative in ware's circulation, including in ports that still suffering from the phenomenon of congestion since forever on one hand, and on the other hand, reduce the rate of port litigation, the World Customs Organization WCO, had proposed in 2005, a set of standards called "safe framework of standards," which include four axes, including the statue of authorized economic operator. This statue won the attention of most states including Algeria, who adopted it in 2010, and organized it in 2012 through Executive Order No. 12-93 which sets of surroundings, the conditions to acquire the quality of the authorized economic operator, and then the procedures before putting the file to the customs administration to take the decision to grant or not the quality. If the decision was in the favor of the applicant, it has several advantages such as simplification of customs procedures, priority treatment of wares and clearance in distance. Internationally, it will benefit from customs simplifications granted in other states as part of what is called "mutual recognition agreements". However, the benefit is required to perform certain obligations, most of which is of a moral nature.
