جدل الخطاب الفقهي والسياسي، قراءة في كتاب الولايات للونشريسي

الملخص
Abu ’l-ʿAbbāsal-Wans̲h̲arīsī (914 AH/1504 AD) was a Maghrebian scholar, according his Book, Kitab al Wilayat (the Book of Governance or Provinces). I will try to present an approach on the dialectical relationship between religion and politics. al-Wans̲h̲arīsī had explained the mechanisms that guides the government to rules people in good way according to the Islamic law. The question of the authenticity of political system and the ways of governance and its adaptation to the legal low was considered by some scholars as a pretext to realize material purposes and not to established justice. In the context, I will try to understand and explain some political question and problems according to the efforts of al-Wans̲h̲arīsī in his books; Kitab al Wilayat. أولى فقهاء المالكية الشأن السياسي عناية خاصة عكستها مختلف الكتب المصنفة في الآداب السلطانية والسياسة الشرعية على اختلاف مرجعياتها الفقهية والكلامية والفلسفية؛ ويبدو أنّ اهتمامهم بهذا النوع من التصانيف جاء من منطلق يقوم على شمولية الفقه ومواكبته لكل مظاهر المجتمع الإسلامي بما فيها المظهر السياسي، لذا ما انفكت خطاباتهم الفقهية تناقش مسائل سياسية هامة وجوهرية من قبيل مفهوم السلطة وآليات تسييرها، ومقتضيات الحكم، وأخلاقيات الحاكم ووظيفته ضمن إطار جدلي تجاذبته ثنائية الفقهي والسياسي.
