الملخص
انطلاقًا من مبدأ سمو الدستور واحترامًا لقواعده، يجب على جميع القوانين أن لا تخالف في أحكامها الدستور أو أن تتعارض معه، وإلّا كانت هذه النصوص عرضةً للبطلان ولهذا سيتوجب وجود هيئة مختصة بالرقابة الدستورية للتأكّد من عدم مخالفة هذه القوانين لأحكام الدستور، وتمتاز برقابة الزامية سابقة هدفها مراقبة خضوع القوانين للدستور والتزامها به . Starting from the principle of the supremacy of the constitution and respecting its rules, all laws must not violate or contradict the provisions of the constitution, otherwise these texts are subject to nullity and for this there must be oversight over the constitutionality to ensure that these laws do not violate the provisions of the constitution, It has a previous mandatory oversight aiming to monitor the compliance of laws with the constitution and its commitment to it.
