الملخص
قد يحدث في الحياة الزوجية أن تكره الزوجة زوجها وتتضرر من بقائها معه لأنه لا يفي بحقوقها أو لا يفي بمتطلبات عقد الزواج. وقد تلجأ الزوجة إلى القضاء لطلب فك الرابطة الزوجية عن طريق الخلع، حيث يتعين عليها أن تتفق مع زوجها على فك العصمة، وتسمى الفرقة في هذه الحالة بالخلع إن الخلع الذي جاء به الكتاب والسنة هو أن تكره الزوج البقاء مع زوجها، فتعطيه المهر الذي قدمه لها .
