دور إرتفاقات التعمير في حماية الممتلكات الثقافية

الملخص
تعتبر إرتفاقات التعمير بمثابة الأعباء والقيود التي تفرض على عقار بسبب موقعه ليس لفائدة عقار آخر وإنما خدمة للمصلحة العامة العمرانية، وتهدف الدراسة الى البحث في أحكام هذه الارتفاقات وتحليلها باعتبارها وسيلة من وسائل التخطيط الحضري تتجسد في أحكام المخططات العمرانية ، حيث تتدخل بواسطتها الإدارة بأدوات منهجية ووثائق مرجعية لتنظيم استعمال المناطق وتخصيص وظيفة لكل منها بهدف حسن تنظيمها سواء تعلق الامر بارتفاقات البناء التي تضبط حدود إستعمال العقار أو تقلّص من إستعماله ، أو إرتفاقات عدم البناء التي تحدّ من الامتيازات التي يخولها حق الملكية للمالكين العقاريين بهدف تخطيط حضري محكم، وبذلك تعتبر ارتفاقات التعمير من وسائل التحكم في المجال العقاري تستعملها الإدارة لحماية الممتلكات الثقافية العقارية. Les servitudes d’urbanisme sont considérées comme les charges et les restrictions imposées à un immeuble en raison de son emplacement, non pour le bénéfice d'un autre immeuble, mais pour l'intérêt urbain public, L’étude vise à étudier les dispositions de ces servitudes et à les analyser en tant que moyen de planification urbaine incorporé dans les dispositions des plans urbains, dont l’administration intervient avec des outils méthodologiques et des documents de référence pour réglementer l’utilisation des régions et l’affectation d’une fonction pour chacune dans le but d'une bonne organisation, qu'il s'agisse des servitudes de construction qui contrôlent les limites d'utilisation d’immeuble ou en réduisent l'utilisation, Ou des servitudes de non-construction qui limitent les privilèges accordés aux propriétaires par le droit de propriété aux fins d’une planification urbaine solide, Ainsi, les servitudes de reconstruction sont considérés comme des outils de contrôle du domaine immobilier utilisés par l'administration pour protéger les biens immobiliers culturels Urbanisme servitudes are considered as the burdens and restrictions imposed on a property due to its location not for the benefit of another property, but in the public interest of the urbanism, the study aims to research on and analysis of the provisions of this servitudes as a mean of urban planning, embodied in the provisions of the urban schemes, which interfere with tools reference documents management methodology to regulate the use of the areas and the allocation of posts for each of them to a good organized both in the building servitudes which adjusts the limits of the use of the property or reduce the use or unbuilt limiting the privileges conferred by the right of the property ownership to urban planning, thus the urbanism servitudes are means of control in the property domain used by the administration to adjust and real estate cultural property
