تأثر القوامة الشرعية بالنفقة الزوجية

الملخص

الأصل في النفقة الزوجية أنها تقع على عاتق الزوج ابتداء، وذلك اقتضاء لمعاني القوامة الشرعية، باعتباره رئيس للعائلة والمسؤول عن أمنها الاقتصادي، فامتناع الزوج عن الإنفاق، وخروج المرأة لسوق العمل ومشاركة زوجها في الإنفاق على مؤسسة الأسرة أثّر سلبا على القوامة الشرعية للزوج، في ظل ما تدعوا إليه الاتفاقيات الدولية و الجمعيات النسوية اللائكية بجعل المرأة على قدم المساواة مع الرجل دون النظر للاعتبارات الفطرية والخلقية والشرعية التي تميز الجنسين، وهي من النوازل التي طرحت بشدة على طاولة النقاش الفقهي المعاصر، فأقيمت مجامع فقهية وعدلت قوانين لأحوال شخصية على غرار قانون الأسرة الجزائري الذي ألغى المادة 39 من ذات القانون المتعلقة بالقوامة. The Principle of Spousal Financial Support falls on the husband initially, in line with the meanings of legal status, considering him as the head of the family and responsible for its economic security. The husband's refusal to spend and the woman's entry into the workforce, as well as her sharing in family expenses, negatively impacted the husband's legal status, in light of international agreements and secular feminist associations advocating for gender equality without considering the natural, ethical, and legal considerations that distinguish between the sexes. This issue has been strongly debated in contemporary jurisprudential discussions, leading to the convening of jurisprudential assemblies and amendments to personal status laws, such as the Algerian Family Law, which abolished Article 39 of the same law related to legal status
