جوانب الإضافة والإبداع في درس المقاصد عند الإمام الشاطبي

الملخص
تتجلى أهمية علم المقاصد عندما حاول الإمام الشاطبي التدليل على قطعية الأصول بقوله: "إن أصول الفقه في الدين قطعية لا ظنية". وقد جاء هذا البحث للحديث عن جوانب الإضافة والإبداع في درس المقاصد للإمام. وخلص لنتائج أهمها ضرورة ربط الفكر المقاصدي للإمام بالدراسات والقضايا الفقهية المعاصرة، وأن المعرفة بمقاصد التشريع يعتمد في المقام الأول على المعرفة العميقة للقرآن الكريم والسنة النبوية الصحيحة. The importance of the science of purposes is evident when Imam Al-Shatibi tried to demonstrate the definitiveness of the principles by saying: "The fundamentals of jurisprudence in religion are definitive, not presumptive." This research came to talk about the aspects of addition and creativity in the study of the purposes of the imam. He concluded with results, the most important of which is the need to link the intentional thought of the imam with contemporary jurisprudential studies and issues, and that knowledge of the objectives of legislation depends primarily on deep knowledge of the Holy Qur’an and the correct Sunnah of the Prophet.
