الملخص

تهدف هذه الورقة البحثية إلى تقصي مدى هيمنة رئيس الجمهورية على السلطة التشريعية ومدى وجود ضمانات كفيلة وكافية تحول دون التعدي على الاختصاصات الأصيلة للبرلمان، ولا تؤدي الى التعسف في استعمال السلطة، التي توصلت باتباع خطوات المنهج الوصفي الى أن التعديل الدستوري لسنة 2020 أكد على صلاحيات رئيس الجمهورية في المجال التشريعي، على غرار منح رئيس الجمهورية حق حل المجلس الشعبي الوطني والمساهمة في تشكيل مجلس الأمة تكريسا لهيمنة السلطة التنفيذية على نظيرتها التشريعية. This research paper aims to investigate the extent of the dominance of the President of the Republic over the legislative authority and the extent to which there are sufficient and sufficient guarantees that prevent infringement of the original competencies of Parliament, and do not lead to the abuse of power, which, by following the steps of the descriptive approach, concluded that the constitutional amendment of 2020 confirmed the powers of the President The Republic in the legislative field, similar to granting the President of the Republic the right to dissolve the People’s National Assembly and to contribute to the formation of the National Assembly in order to establish the dominance of the executive authority over its legislative counterpart.
