الملخص
الملخص: من النُظُم و الشرائع التي أتت بها الشريعةُ النبوية تيسيراً على الناس، و تنظيماً لعلاقاتهم في حياتهم اليومية نظام القسمة، و القسمة بوصفها نظاماً من النظم و عقدا من العقود ذات ماهية و أنواع و ظروف، و قد بين مشروعيتها المذاهب الإسلامية بما فيها مذهب الإمام الشافعي - رح -، و استندوا إلى الآيات و الأحاديث الواردة فيها: کـ"و اعْلَمُوا أَنَّما غَنِمْتُمْ مِنْ شَيْئٍ فَإِنَّ لله خُمَسَهُ و لِلرَّسُولِ و لِذِي القُرْبَى و اليتامى و المساكينِ و ابنِ السبيلِ" و تقسيمِ الغنائم من النبي - صلی الله عليه و سلم - بغزوة حنين؛ و من أنواعها قسمة المتشابهات التي اختلف الفقهاء الشافعية في كونها بيعاً أم إفرازاً للحق؟، و التي تناولناها في هذه الدراسة على أساس تحليل المحتوى و توصيفه. الكلمات المفتاحية:القسمة، قسمة المتشابهات، البيع، إفرازالحق. Abstract: The division of common property is one of the rules that Islamic law has legislated and approved in order to facilitate the affairs of life and also to regulate the financial relations of the people in daily life.This important matter is as one of the rules of systematization of financial affairs including nature, types, conditions, and a special framework that Islamic religions, and the religion of Imam Shafi'i - Rah - have proved its legitimacy and had cited the verses and hadiths in this regard, Such as: "Be aware that if you benefit from something, God has intended one-fifth of it for the Prophet and the orphans and the needy and the children of Ibn al-Sabil" , as well as the distribution of trophies by the person of Prophet - PBUH - in the battle of Hanin. One of its types is the division of similarities in which Shafi'i jurists have disputed whether it is for sale or not, and this study seeks to find the root causes of this difference, statement of reasons , and adhering to dispute parties in a descriptive-analytical manner.
