طرق حل الخلافات الزوجية بين التأصيل الشرعي وقانون الأسرة الجزائري

الملخص
تعتبر الخلافات الزوجية من أكبر المشاكل التي تواجه الأسر، والطلاق أكبر خطر يهددها إلا أنه شرع على كراهته في الإسلام كمنفذ أخير لحل مشكلات الأسرة متى تفاقمت واستعصت عن الحل وامتنعت كل جهود التوفيق والإصلاح والتحكيم شرعا وقانونا، فالطلاق لم يجعله الشرع والقانون أول علاج يلجأ إليه المرء إذا ما ظهرت بوادر الشقاق، وإنما شرع من الأوامر والأحكام ما ان اتبعت لا يقع الطلاق إلا عند وجود ما يقتضيه ولإستقرت الحياة الزوجية على قرار مكين، فيكون الطلاق علاج لمشكلات الأسرة التي تعجز عن حلها الوسائل الأخرى وباتباعها أيضا تنتفي المفاسد التي تنجم عنه، ولعلاج الخلافات الزوجية طرق ومراحل، فما هي طرق حل الخلافات الزوجية من خلال التأصيل الشرعي وتحليل قانون الأسرة الجزائري الصادر بالأمر 05/02 في 27 فبراير 2005 ؟ .
