مجلة "الدراسات الإستراتيجية والبحوث السياسية" هي مجلة دولية سداسية محكمة ومجانية تشرف عليها هيئة تحكيم متخصصة ذات كفاءة علمية تعنى بتقييم الأبحاث. تصدر عن مخبر "الدراسات الإستراتيجية والبحوث السياسية" –جامعة تلمسان (الجزائر)، تهدف المجلة إلى نشر البحوث العلمية الأصيلة للباحثين، الأساتذة وطلبة الدكتوراه، باللغات الثلاث: العربية، الفرنسية والانجليزية، في مختلف مجالات العلوم الاجتماعية والإنسانية بكل فروعها: العلوم السياسية، العلاقات الدولية، القانون، الاقتصاد، التاريخ... وغيرها من المجالات المعرفية ذات الصلة. يشترط في المقالات الواردة للمجلة الجدية، الرصانة وتقديم الإضافة العلمية، و يجب أن يتقيّد الباحث بأصول البحث العلمي وقواعده العلمية والمنهجيّة، بالإضافة إلى الأمانة العلمية؛ وتخضع المقالات الواردة إلى للتحكيم العلمي الأكاديمي حسب الشروط والأصول العلمية المتبعة. The Journal For Strategic Studies And Political Research is an international, biannual, peer-reviewed and free journal . It is supervised by a specialized and competent scientific committee that reviews and evaluates research. It is issued by the Laboratory For Strategic Studies And Political Research. The journal aims at publishing authentic and scientific research of researchers, professors and doctoral students; using the three languages :Arabic, French and English; In different fields of the social and human sciences and their subfields: political sciences, international relations, law, economy, history, as well as all the other related disciplines. The received articles are required to be serious and provide scientific contributions, also, the researcher should conform to the scientific and methodological research rulesand standers , in addition to scientific integrity. The received articles will be subject to scientific and academic peer-review in accordance with scientific standers and regulations.

Résumé: Dr. Shady Ahmed Mansour is an Associate Professor of Political science at the National Defence College (NDC) of the United Arab Emirates, and an expert on security studies. Before joining the NDC, he worked at Information Decision and support center (IDSC), a governmental thinktank affiliated to prime minister office, Egypt, until 2012. Later, he joined Future for Advanced Research and Studies, UAE, in 2014, where he held the position of Editor-in-Chief of the Journal “Trending Events”, as well as the head of security studies unit. Dr. Shady earned a Ph.D. in Comparative Politics from Faculty of Economics and Political Science, Cairo University (Egypt) in 2015. His dissertation examined how to resolve internal conflicts in divided societies by utilizing complex power sharing regime. Dr. Shady has a number of publications on the MENA region, in Arabic and English, like the following book chapters “Wedge strategy: How Saudi Arabia is attempting to influence the Syrian conflict?”, (Springer, 2021), and “Rising challenges to the US-led regional security architecture in EU and the Gulf region” (Palgrave Macmillan, 2022). Research interests also included a focus on war and intelligence studies. In this regard, Dr. Shady published three books in Arabic titled: “Fifth generation warfare” (2019), “Analyzing international relations developments and forecasting its developments utilizing Intelligence approaches” (2023), and “International Security Studies; the hidden dimension in conducting the foreign policy of states” (2023).

التنظيم القانوني لعقد العمل بشرط التجربة

الملخص: تتناول هذه الدراسة التنظيم القانوني لعقد العمل بشرط التجربة والذي جاء نتيجةً للطبيعة القانونية التي يختص بها عن عقد العمل البات. وعلى الرغم من أنَّ المنظّــــم السعودي قد أحاط فترة التجربة بجملة من الشروط والقيود التي تضمن حُسن تطبيقه بعيداً عن إساءة الاستعمال أو التحايل؛ إلّا أننا نجد أن ضمانات حماية العامل من تعسُّف صاحب العمل عند إنهاء فترة التجربة لا تكفل تحقيق التوازن بين الحق المشروع لصاحب العمل بأن يتعاقد مع من تثبت لديه صلاحيته وكفاءته للعمل، وبين حق العامل في ألّا يُفسخ هذا العقد إلّا لأسباب ترجع إلى عدم صلاحيته أو عدم كفاءته، لذلك؛ فقد جاءت هذه الدراسة بهدف معالجة مسألة عدم وجود الحماية النظامية التي تشترط استظهار أسباب إنهاء صاحب العمل لعقد العمل أثناء فترة التجربة، وقد توصَّلت الدراسة لعدّة نتائج، أهمّها: أنَّ القيود التي أوردها المنظم على تمديد فترة التجربة وجواز تكرارها أسهمت في حماية العامل من إساءة استعمال وتحايل أصحاب العمل عند تطبيقهم لتلك الصلاحيات. This study examines the legal regulation of employment contracts with a probationary period clause. Although Saudi regulations have taken into account the probation period with a set of conditions to ensure its fair application, we find some remarks worth mentioning. The safeguards that protect the worker from employer abuse upon termination of the probation period might not ensure a balance between both parties. The legitimate right of the employer to contract with someone proven to be qualified for the job, and the right of the worker not to have the contract terminated except for reasons related to their competence. Then we address issue of the absence of regulatory protection requiring employers to provide reasons for terminating employment contracts during the probation period. It concluded that the restrictions imposed by the regulator on extending the probation period and allowing its repetition contributed to protecting the worker from abuse by employers when exercising these powers.
