الوظيفة التّرجيحيّة لأسباب النّزول

الملخص
الملـــــخّص: يتمّ توظيف أسباب النّزول على درجات، أدناها الاستعانة بها على تجلية معنى، وأعلاها القيام بالوظيفة التّرجيحيّة، وهي نفسها على درجات إذ لاشكّ أنّ الترجيح الأصوليّ بإظهار الصّورة الحقيقيّة للدّلالة من خلال أنّه إذا ورد الخطاب بالعموم، وظهرت قرينة سببيّة فإنّها تقيّد إطلاق العموم في عمومه، وإن كان النّصّ يوحي ظاهره بمعنى قد يخالف نصًّا غيره فلا بدّ من جمع الآيات ثمّ النّظر في أسبابها فإنّه يساعد هذا الجمع بدلالة السّبب على إخراج المعنى لكلّ نصّ، وينفع أيضًا ما لو كان للنّصّ معنيان أحدهما أصليّ والآخر تابع، فالمصير للأصليّ بمدلول السّبب ولا بأس بإلحاق الثّاني، ومن النّاحية الفقهيّة قد يحتمل النّصّ حكمًا في السّياق النّصّيّ، وبالعودة إلى سبب النّزول يتجلّى توجيه الحكم إلى ظاهر الآية، و مثل هذا إذا كان الظّاهر قد يوهم بجواز فعل الفعل، وليس يجيزه في الحقيقة، ولو احتمل النّصّ حكمين أحدهما الواجب والثّاني ما هو أوجب منه، يدخل السّبب ليبيّن أوّل الواجبين وأظهرهما وألصقهما بالسّياق. Summary : The descent reasons on the degrees are employed the lowest one is to use them to clarify the meaning and the highest one is to do the weighting function and it is the same on degrees in addition to this there is no doubt that the fundamentalist weignting by showing the real pictures for the significance is by the way that if the speech is received in general and a causal hypothesis appears it restricts the general in its general but if the appare of the text shows a meaning that may contradict the text of the other then it must collect the verses and consider its reasons so this combination in terms of tha cause to extract the meaning of each text ; its useful also if the text has two meanings one of which is original and the other is related so the fate is for the original one by the Reason and there is no problem to append the second ; frpm the jurisprudential point of view that the text may include provision in the textual context and by the return to the cause of descent the direction of the provision is reflected in the appearance of the verse and such if the apparent may be inspired by the permissible act , and does not allow in fact , even if the text contained two provisions , one duty the other is what is required from it ; then the Reason enter to show the first of the two duties and the appearant one also the one that past the most into the context.
