زواج ذوي الاحتياجات الخاصة بين أحكام الشريعة الإسلامية ونظرة المجتمع

الملخص
يكتسي موضوع زواج ذوي الاحتياجات الخاصة أهمية كبيرة، كونه من المواضيع الشائكة والحساسة التي تحتل حيزا مهما في حياة هذه الفئة؛ نظرا للصعوبات التي يواجهونها في تلبية رغباتهم واحتياجاتهم الطبيعية والشرعية، في ظل نظرة المجتمع إلى خصوصية كل واحد منهم، وفيما مدى قدرتهم على تكوين أسر، واندماجهم في الحياة الزوجية، ولا شك أن الشريعة قد تكفلت بشؤون هذه الفئة، وضمنت لها بتشريعاتها المختلفة حق الحياة الكريمة، ومن هنا يمكن أن تُثار الإشكالية الآتية: ما هي أحكام زواج ذوي الاحتياجات الخاصة في الشريعة الإسلامية مقارنة بنظرة المجتمع؟ ويأتي هذا البحث للإجابة عن هذه الإشكالية ببيان مفهوم ذوي الاحتياجات الخاصة، وأنواع الإعاقة لكل فئة منهم، وتوضيح المبادئ العامة في التعامل معهم في الإسلام، وأهم العوائق والصعوبات في المجتمع التي تحول بينهم وبين حقهم في الزواج، والتعرض للمسائل الفقهية التي تخص ذوي الاحتياجات الخاصة في باب الزواج من حيث معايير اختيار الشريك المناسب، واشتراط الكفاءة، وصحة العقد ولزومه والضوابط الشرعية له، وحق إنجاب الأولاد، وكيفية ممارسة الحقوق الزوجية، وما يترتب عليها من مسؤولية النفقة وتربية الأولاد، مقارنة بنظرة المجتمع في كل مسألة باستخدام المنهج الوصفي والتحليلي بشكلٍ أساسٍ مع استعمال متفاوت للمنهج الاستقرائي. Those of special needs marriage in Islamic Shari'a vs the view of society Abstract: Those of special needs marriage is an issue of a great importance, as it is a sensitive subject which has a big place in the life of this group because they face many difficulties to make their wishes come true and to meet their natural and religious needs. Knowing that the society has a view of the privacy of each of them and if they are able to make families, and their integration into marriage life. There is no doubt that the Shari'a has ensured the affairs of this category, and guaranteed by its various rules the right to a decent life. Hence the following problem can be raised: What are the provisions of the marriage of those of special needs in Islamic Shari'a compared to the view of society? This research comes to answer this problem by presenting the concept of people of those of special needs, the types of disability for each category. We will clarify the general principles in dealing with them in Islam and the most important obstacles and difficulties in society that deprive them of their right to marry. Many Fikh subjects will be studied in this work : how to choose the good wife or husband? Requirement of competence. The validity of the contract. Its religious conditions. The right to have children. How to exercise marital rights? and the consequent responsibility for the maintenance and raising of children. Each subject has been compared to the Society's perception using a descriptive and analytical approach, with a mixed use of the inductive method.
