مراحل تطور المذهب المالكي ومميزاتها

الملخص
الملخص تعرض المذهب عند المالكية إلى مراحل مختلفة من التطور الاصطلاحي والعلمي منذ أن أسسه الإمام مالك، وكان لكل مرحلة خصائصها، وميزاتها، وقد اختلف العلماء في تقسيم هذه المراحل إلى خمسة مراحل، وهناك من جمعها في ثلاثة مراحل فقط وعلى رأسهم دراسة الفضل بن عاشور والتي تبقى أكثر شمولية من غيرها، وكانت مراحل نشأة المذهب المالكي بصفة عامة هي: مرحلة التأسيس ، ومرحلة التفريع، ومرحلة التطبيق، ثم مرحلة التنقيح والنقد، ثم مرحلة الجمع والاختصار، أما تقسيم الفضل بن عاشور لمراحل المذهب فكان يندرج في ثلاثة أدوار رئيسية ، كان لكل مرحلة خصائصها ومميزاتها متمثلة في: أولا: دور النشوء: التأسيس والتأصيل: وهو مرحلة التأصيل والتأسيس تميزت بظهور شخصية مالك العلمية المزدوجة التخصص، التي جمع فيها بين علم الحديث و علم الفقه. ثانيا: دور التطور: شمل تحته مراحل التفريع، والتطبيق، والترجيح، وتميز بظهور نوابغ المالكية ثالثا: دور الاستقرار: تميزت هذه المرحلة بظهور الشروح، والاختصار، والحواشي، والتعديلات، أما السمة المميزة لهذا الدور أنه "دور الترجيح، يعتمد درس الأقوال وتمحيصها، هذه المميزت والخصائص لهذه المراحل، جعلت منه مذهبا راسخا واضح المعالم مستمرا بقوة إلى يومنا هذا. Abstract Since its foundation by the Imam Malik, the Maalikis’ doctrine has incurred different stages of conventional and scientific development ; subsequently, each stage has its own characteristics and proper features. However, scholars have diverged in dividing these stages; some of them have divided it into five, where as others have gathered it in only three stages, on the top of them, El-Fadhel Ben Achour’s study which remains the most thourough and inclusive than the others. Therefore, broadly speaking, the stages of the emergence of the Maliki doctrine were : the Foundation stage, the branching stage, the application stage, the revision and critique stage, then finally the collecting and abbreviation stage. Nevertheless, El-Fadhel Ben Ashour’s division to the stages of the doctrine were graded into three main roles, each phase has its own characteristics and proper features represented in : First: The role of emergence: foundation and rooting: this is the stage of establishing and rooting was characterised by the emergence of Malik’s scientific personality of the dual specialization in which he combined between both the science of the hadith and Islamic jurisprudence Science i.e Fiqh. Second: The role of evolution: It encompasses the phases of branching, application and weighting. It was distinguished by the emergence of the Malikis most prominent figures Third:The role of stability: This stage was marked by the appearance of explanations, abbreviations, footnotes and amendments. However, the most distinctive feature of this role is the role of weighting depending on the lesson of words and its scrutiny.Consequently, these distinctive features of the stages of development, has made it an outstanding distinct firmly established doctrine constant vigorously to this day.
