التصرفات الواردة على حقوق مالك البراءة

الملخص
الملخص: القاعدة العامة أن حقوق الاختراع تخول صاحبها حق الاستئثار والتصرف والاستغلال، حيث لا يجوز للغير استغلالها واستثمارها على أي وجه كان دون موافقة مالك البراءة القانوني، غير أن هذه الحقوق التي ترد على الاختراع ليست مطلقة، ذلك أنه قد ترد عليها بعض الاستثناءات التي من شأنها أن تقيّد حقّ التصرف والاستغلال المالي للاختراع في حالات معينة حددتها تشريعات الملكية الصناعية، كحالة عدم استغلال صاحب الاختراع اختراعه خلال مدة حددها القانون، أو حالة عدم تحقيق الاكتفاء الذاتي للاحتياج القومي الوطني للمنتج المبرأ... وهنا تجد الدولة نفسها مجبرة على التدخل للقيام بإجراءات قانونية معينة لكسر ذلك الاستئثار بإدخال الغير طرفا مساهما من خلال منحه ترخيصا باستثمار الاختراع دون إضرار بحقوق مالك البراءة في إطار تحقيق المصلحة العامة. Abstract: As a general rule that the patent rights, shall be granted : right of Monopolization, right to act and exploitation, Where may not be exploited and invested in any way without the consent of the patent owner, However, these rights which are contained in the invention are not absolute, There may be some exceptions that would restrict the disposition right and financial exploitation of the invention in certain cases, which defined by industrial property legislation, Such as the non-exploitation of the invention within the period specified by law. Or the non-self-sufficiency of the national need of the product protected by the patent .here a government allows someone else to produce a patented product or process without the consent of the patent owner .By imposing the penalty of the compulsory license to invest the invention, and to break the exclusive right without prejudice to the rights of the patent owner in the framework of achieving the public interest.
