الملخص
تهدف هذه الدراسة إلى البحث في دور فقهاء وعلماء الغرب الإسلامي في مناقشة قضايا التمدن، وإنتاج نصوص فقهية قانونية تتوافق مع الإشكالات والخصومات التي تطرح على الفقيه والقاضي بهدف تنظيم وتسيير العلاقات الاجتماعية ضمن مجال العمران والمدينة في المنطقة. هذا الأمر يستوجب تتبع التأليف والمؤلفات في مجال فقه البنيان بشكل تاريخي والوقوف على تطور وتنوع قضاياه من فترة الفتوحات إلى غاية القرن 4ه/10م، مع البحث في أسباب تفوقه وتنوعه في الأندلس وإفريقية وغياب أو ضياع المؤلفات في المغربين الأوسط والمغرب الأقصى. The purpose of this study is to investigate the role of fouqaha of the Islamic West in discussing the issues of urbanization and in the production of jurisprudential legal texts that correspond to the problems and disputes posed to the Faqih and the Judge in order to organize and manage social relations within the area of urbanization in West islamic. It is necessary to trace the authorship and works in the field of jurisprudence in a historical manner, and to examine the development and diversity of its issues from the period of islamic conquests until the end of the 4th century / AD 10, and also researching on the reasons for its superiority and diversity in Andalusia and Ifriquya, and the absence or loss of works in both middle maghreb and maghreb Al aksa.
