الملخص: الملخص: ملخص: بفضل الأمر رقم 15-01 الصادر بتاريخ 23 يوليو 2015، المتضمن قانون المالية التكميلي لسنة 2015، أضحى الأشخاص الناشطون في إطار السوق الموازية أو ما يسمى بالسوق السوداء يتمتعون بالحق الكامل في الانتساب الطوعي إلى صناديق الضمان الاجتماعي، والاستفادة بذلك مع ذوي حقوقهم من الأداءات العينية المتعلقة بالتأمين على المرض و/أو الأمومة، وذلك مقابل دفع اشتراك شهري يتم احتساب نسبته من أساس مبلغه يساوي الأجر الوطني الأدنى المضمون (أ .و. ق .م). يسري هذا الإجراء لفترة انتقالية، بحيث يتوجب على الأشخاص غير المكلفين في مجال الضمان الاجتماعي المنتسبين عن طواعية إلى صناديق الضمان الاجتماعي، تسوية وضعيتهم المهنية حسب ما تقتضيه القوانين والتنظيمات السارية المفعول. يحق للشخص الذي صرح بنشاطه في هذا الإطار، بعد تسوية وضعيته المهنية واكتسابه لصفة المكلف في مجال الضمان الاجتماعي، دفع اشتراك تعويضي للتقاعد بعنوان المرحلة الانتقالية السابقة لهذا التصريح. Résumé : C’est grâce à l’ordonnance n°15-01 du 23 juillet 2015, portant loi de finance complémentaire de l’année 2015, que les personnes activant dans l’informel ont plein droit actuellement à une affiliation volontaire aux caisses de sécurité sociale, et peuvent bénéficier avec leurs ayants droit des prestations en nature de l’assurance maladie et/ou maternité, moyennant le versement d’une cotisation mensuelle assise sur une assiette, dont le montant est égal au salaire national minimum garanti (SNMG). Cette disposition est applicable pour une période transitoire, pendant laquelle les personne non assujettis à la sécurité sociale (activant dans l’économie informelle) affiliées volontairement aux caisses de sécurité sociale, doivent formaliser leur situation professionnelle par l’un des moyens légaux. La personne qui a procédé à la formalisation de sa situation pendant la période transitoire, acquiert la qualité d’assujettis à la sécurité sociale. La déclaration d’assujettissement à la sécurité sociale introduite dans ce cadre, permet en outre à la personne concernée de bénéficier d’un rachat à sa charge de cotisation de retraite au titre de la période transitoire, précédant cette déclaration Abstract: It is thanks to Ordinance No. 15-01 of July 23, 2015, introducing supplementary finance law of the year 2015, that persons activating in the informal, have currently full right to voluntary affiliation to the social security funds and are entitled to benefits under sickness and / or maternity insurance with their beneficiaries just by paying a monthly contribution based on a base, the amount of which is equal to the guaranteed national minimum wage (SNMG). This provision is applicable for a transitional period, during which non-social security (active in the informal economy) voluntarily affiliated to the social security funds must formalize their professional situation by one of the legal means. The person who has carried out the formalization of his situation during the transitional period, shall acquire the status of a person liable to social security. The declaration of liability to social security introduced in this context also allows the person concerned to benefit from a pension repayment of his pension contribution for the transitional period preceding that declaration
