عقد تحويل الفاتورة في القانون الجزائري

الملخص

تبنى المعاملات التجارية على مبدأ السرعة والائتمان والثقة لذلك يلجأ التجار إلى إقامة علاقات دائنة فيما بينهم، فيكون الوفاء لأجل، أين يلجا المتعامل في هذه الحالة إلى تحرير فواتير، غير أ نه قد يجد نفسه في حاجة إلى السيولة النقدية في الوقت الذي يملك فيه أموالا في ذمة الغير، هذه الأموال إما أنها غير مستحقة الدفع لأن أجل استحقاقها لم يحن، وإما لأن تكاليف تحصيلها باهظة إذا كان المدين يقيم في الخارج. ولإيجاد حل للخروج من هذه الضائقة المالية، كان لابد من إيجاد تقنية يستطيع من خلالها المتعامل تمويل وتسيير وكذا تحصيل حقوق زبائنه. مسايرة لمستجدات العصر خاصة في ظل الاقتصاد الحر، نظم المشرع الجزائري عقد تحويل الفاتورة باعتباره ميكانزيم عملي لتمويل الديون وتسييرها وكذا تحصيلها، وذلك ضمانا لحسن سير المعاملة، والحفاظ على مبدأ التعاون الشامل،وكذا الثقة والائتمان. Commercial transactions are based on the principle of speed, credit and trust, Therefore, traders resort to relationships Creditors among them, Then the fulfillment of the order, where the customer is in this case, leads to a factoring, but he may find himself in need of cash at the time when he owns funds in the care of others, these funds are either not payable because their due date has not yet arrived, or because collection costs are prohibitive if the debtor resides abroad. To find a solution out of this financial crisis, it was necessary to find a technology through which the customer can finance and manage as well as collect the rights of his clients. In keeping with the developments of the era, especially in light of the free economy, the Algerian legislator organized the invoice transfer contract as a practical mechanism for financing, managing and collecting debts, in order to ensure the proper conduct of the transaction and maintain the principle of comprehensive cooperation as well as trust and credit.
