نظام الشهر العقاري ودوره في حماية الحقوق العينية العقارية دراسة تحليلية على ضوء التشريع والاجتهاد القضائي الجزائري

الملخص
الملخص: يهدف المشرع الجزائري من وراء سن نظام الشهر العقاري تنظيم الملكية العقارية، وتوفير ضمانة وحماية كافية لمن تنتقل إليه ملكية الحق العيني العقاري، أو ترتب له حق عيني عقاري، وقطع السبيل على المنازعات المحتملة بخصوص الحقوق العينية المترتبة على العقارات المشهرة والمقيدة بالسجل العقاري، وإقامة نظام عقاري على أسس متينة، وتوفير اكبر قدر من الطمأنينة للمتعاملين بالعقار، الشيء الذي يساهم في تطوير الائتمان العقاري وازدهاره واستقرار المعاملات. الكلمات الدالة: الشهر؛ الملكية؛ عقاري؛ رهن؛ قيد. Résumé : Le Législateur Algérien a pour objectif de règlementer de bien immobilier et d’assurer une sécurité et une protection appropriés à ceux qui sont transférés dans le droit immobilier ou ont le droit à l’immobilier et de régler les litiges potentiels concernant les droit en nature des biens immobiliers enregistrés et inscrits au registre immobilier. La plus grande quantité possible de garantie pour courtiers immobiliers, ce qui contribué au développement du crédit immobilier et a la prospérité et a la stabilité des transactions.
