الملخص

ملخّص: نظرا لأن العقوبة السالبة للحرية قصيرة المدة التي كثرت عيوبها وأصبحت تسهم في نشر الجريمة بدلا من أن تحد منها، فقد اهتمت السياسة العقابية المعاصرة بالبحث عن بدائل عقابية تحلّ محلّها. وتعتبر عقوبة العمل للنفع العام حاليا من بين البدائل العقابية التي لجأت التشريعات المقارنة إلى الأخذ بها كوسيلة لإصلاح المحكوم عليهم وتأهيلهم وإعادة وإدماجهم داخل المجتمع. وقد حاولنا من خلال بحثنا هذا التطرق إلى مفهوم عقوبة العمل للنفع العام والشروط الواجب توفّرها للحكم بها، ثم تبيان جهات إصدارها وآليات تنفيذها في القانون الجزائري. Abstract: Given that the penalty of deprivation of liberty for short duration has a lot of disadvantages and became lead to the dissemination of crime instead of limiting it, the modern criminal policy has focused on the search for penal alternatives to replace it. One of the most important alternatives nowadays is the penalty of community service which has been used by comparative law as a means to reform, rehabilitate and reintegrate convicted into society. In this article we have highlighted the concept of community service, also we have reviewed the conditions of community service and tribunals that can issue this penalty, and thereafter we have mentioned the mechanisms of application of community service in the Algerian law. Résumé Étant donné que la peine de privation de liberté de courte durée présente de nombreux inconvénients et conduit à la diffusion de la criminalité au lieu de la limiter, la politique pénale moderne s'est concentrée sur la recherche de solutions de substitution au pénal. L’une des solutions les plus importantes à l’heure actuelle est la peine de service communautaire, qui a été utilisée par le droit comparé pour réformer, réhabiliter et réintégrer les condamnés dans la société. Dans cet article, nous avons mis en évidence le concept de service communautaire, nous avons également passé en revue les conditions de service communautaire et les tribunaux pouvant imposer cette sanction, puis nous avons mentionné les mécanismes d'application du service communautaire dans la loi algérienne.
