حماية الصّحة العمومية بين مقتضيات حفظ النّظام العام وتكريس حق الرعاية الصّحية

الملخص
يعدّ الحق في الصّحة أو حق الرعاية الصّحية من أبرز الحقوق الأساسية المكرّسة دستورا، قانونا وتنظيما، سواء على الصعيد الدولي، الإقليمي أو الوطني. ويتجسّد هذا الحق في جملة من الخدمات؛ على رأسها: إقامة هياكل صحية، توفير الأدوية ومختلف المنتجات الطبية والصّحية، تقديم مساعدات طبية وتمريضية، وحماية الصّحة العمومية سواء بشكل قبلي وقائي أو بعديّ علاجي. ولعلّ هذه الأخيرة –أي حماية الصحة العمومية- تحتاج لوقفةٍ؛ فزيادة عن كونها إحدى أبرز خدمات الرعاية الصحية، نجدها تشكّل إحدى عناصر الثلاثية التقليدية للنظام العام بمفهومه الإداري (أمن-صحة-سكينة: عمومي(ة))؛ وهذا ما يوحي بجمعها بين المتناقضين؛ الوجه الإيجابي الذي يجسّده تقديم خدمات باعتبارها حقّا كرّسه القانون، والوجه السّلبي الذي يتمثل في عملية الضبط الإداري والحدّ من ممارسة بعض الحقوق والحريات قصد حفظ النّظام العام. The right to health or the right to health care is one of the most fundamental rights consecrated by the Constitution and law, at the international, regional or national levels. This right is embodied in a different services: the establishment of health structures, the provision of medicines and medical and health products, the provision of medical and nursing assistance, and the protection of public health, preventive and curative. In addition to being one of the most prominent health care services, it is one of the elements of the traditional trilogy of public order in its administrative sense (security-health-tranquility); which links the two contradictions, the positive aspect embodied in the provision of services as a right consecrated by the law, and the negative aspect of administrative police and limit the exercise of certain rights and freedoms in order to maintain public order
