إنفاق المال الحرام في وجوه البر «دراسة فقهية في ضوء مقاصد الشريعة»

الملخص
يتناول البحث مشكلة إنفاق المال الحرام المأخوذ برضا صاحبه كالأموال المكتسبة من التجارة في المحرمات كالمخدرات ونحوها أو المأخوذة على سبيل الفائدة على القروض (الفوائد البنكية) في وجوه البر والعمل الخيري، ويعرض لصورتين من ذلك، وهما: حكم إنفاق من اكتسب مالا حرامًا ثم تاب لهذا المال في وجوه البر، وحكم إنفاق من اضطر لإيداع ماله بفائدة في البنوك الربوية لهذه الفوائد في وجوه البر- معتمدًا على عدة مناهج علمية، أهمها المنهج الوصفي، والمنهج الاستنباطي، والمنهج التحليلي للوصول إلى جملة من النتائج، أبرزها: أن المال الحرام المكتسب عن طريق التجارة في المحرمات أو كان من قبيل الفوائد الربوية يتم التخلص منه بإنفاقه في وجوه البر من سد حاجة الفقراء والمساكين، والمصالح العامة للدولة، وأنه لا يجوز لمن اضطر لإيداع ماله في البنوك الربوية أن يتنازل عن احتساب الفوائد لتلك البنوك، وإنما الواجب عليه أن ينفقها في وجوه البر. The study deals with the problem of spending the forbidden money taken with the consent of the owner, such as the money acquired from trading in taboos such as drugs, or taken from the bank benefits in the charitable work, It is presented to two cases, namely: the ruling on spending from one who has acquired prohibited money and then repented for this money in charitable work, and the ruling on spending someone who has had to deposit his money with interest in commercial banks for these benefits in charitable work- based on several scientific approaches, the most important descriptive approach, the deductive approach, and the analytical approach to reach a number of results, most notably: that the prohibited money gained through trade in taboo or was like interest in commercial banks is eliminated by spending in charity work to meet the needs of the poor, and the general interests of the state, and that it is not permissible for those who had to deposit their money in commercial banks To waive the calculation of interest to those banks, but must spend in charity work.
