الهجرة غير الشرعية بين ثالوث التحريم الديني والتجريم القانوني والتهديد الأمني.

الملخص
ملخص: نحاول في هذه الدراسة تسليط الضوء على أبرز لمداخل الهام في التعامل ومحاربة الهجرة الغير الشرعية، والتي تعد حسب الباحث مداخل حساسة يجب التأكيد على أولويتنا والأخذ بها عند العامل مع هذه الظاهر التي استفحل التعامل معها نظرا لتشابك مسبباتها وتنامي التهديدات التي تفرزها على كل الأصعدة. إذ نريد من خلال هذا التحليل أن نركز على ثلاث أبعاد هامة والتي يعتبر أبعاد محورية في التعامل مع ظاهرة الهجرة غير الشرعية، البعد الأول وهو موقف الشريعة الإسلامية من هذه الظاهرة وبيان حكمها ضمن أحكام الدين، أما البعد الثاني فقد ركزنا من خلاله على التعامل القانوني والتشريعي مع الهجرة غير الشرعية خاصة في الدول المغاربية، في حين أننا ركزنا في البعد الثالث على الجانب الأمني الذي يراه الباحث مدخلا مركزيا هاما عند تحليل ظاهرة الهجرة غير الشرعية. الكلمات المفتاحية: الشريعة الإسلامية، القانون، المواثيق الدولية، التهديدات، الأزمات Abstract : In this study, we attempt to highlight the most important approaches to dealing with illegal migration, which, according to the researcher, are sensitive entries. We must emphasize our priority and take it into account with this phenomenon, which has become more difficult to deal with because of the complexity of its causes and the growing threats it produces at all levels. Since we want through this analysis should focus on three important dimensions are considered focal dimensions in dealing with the phenomenon of illegal immigration, the first dimension is the position of the Islamic phenomenon and indicate its judgment within the terms of the debt, the second dimension have focused on dealing with legal and legislative Illegal immigration, especially in the Maghreb countries, while we focused in the third dimension on the security side, which he sees as an important researcher Central input when analysing the phenomenon of illegal immigration.
