بيع السلم الفاسد حدوده وطرق تصحيحه في الفقه الإسلامي.

الملخص
ملخص: يعتبر مجال بيوع السلم واسعا من حيث نطاق دراسته وتعلقه بالحياة اليومية للفرد المسلم ، سواء مع المسلمين أو مع غيرهم، ولذلك قد يطرأ على البيع ما يؤثر فيه، فتارة يكون التأثير جسيما بحيث تتزعزع أركان العقد فيبطل، وتارة يكون التأثير دون ذلك ، فيفسد العقد، والمؤثرات كثيرة، فقد ترد على أركان العقد وقد ترد على شروطه، لذلك فإن الفساد الوارد على هذه العقود يتخلل كل جوانبها، وبما أن الأصل في التعاقد هو إتمام الصفقات حتى تستقر الأوضاع ويتوصل الشخص إلى غاياته من ورائها، فإن نظرية الفساد جاءت لأجل هذه الغاية، وهي تصحيح الأجزاء الفاسدة من العقود بما فيها عقود السلم، وذلك حفاظا على إتمامها، وابتعادا عن إبطالها. الكلمات المفتاحية :السَّلم‘الفساد‘البيع. Abstract : The domain of Esallam selling’s is widely consider very vast in terms of its study and its dependence to Muslim s daily life, either between Muslims themselves or with others, consequently it may occur what affects the sale, sometimes it is a big affection in which the important elements (the pillars) of the contract may well be shaken so it invalided the selling contract, other times the affection s less so that the contract is correpted,there are many effects, they may affect the pillars of the contract as well as its conditions that, the occurring corruption for these contracts affects all its aspects. Because of the aim of all contract is to achieve the transactions until the stability of situations and the realization of objectives, the theory of corruption is founded in the aim of correcting . The corrupt parts in the contracts among them the contracts of (esalam sale) and that in order to its achievement and to avoid its invalidation.
