المبادئ الرئيسية للإصلاح الشامل لقوانين الهجرة

الملخص
تشهد بعض المجتمعات أنماطا خطيرة من ظاهرة الهجرة، إذ تجسد أهوال الكوارث البحرية المتكررة ومعدلاتها المتصاعدة عمق هذه القضية ألا وهي الهجرة غير الشرعية، في بعديها الإنساني والأمني. حيث أصبحت تحتل مكانا بارزا في العلاقة بين البلدان المتقدمة والأخرى النامية فيها، نظرا لارتباطها بالعديد من الجوانب السياسية والاقتصادية والاجتماعية. كما تشكل أخطر القضايا الاجتماعية التي لا تزال تؤرق المجتمع الدولي. وهو ما أدى بالدول إلى البحث عن سبل مكافحتها والتقليل منها من خلال تطوير العديد من الاستراتيجيات والآليات الأمنية، وحتى السياسات الاجتماعية لتحقيق هذا الهدف. ولكن غالباً ما يتم التعامل مع ظاهرة الهجرة هذه كملف إداري لأمن الشرطة بعيداً عن التخصصات الاجتماعية والنفسية، ويتم التعامل معها ضمن السياسات العامة التي تحافظ على إغلاق الملف داخل الأجهزة الأمنية وبعيداً عن المجتمع المدني والمنظمات ذات الصلة في مجال الوعي. لذا تتطلب المعالجة والحلول من الدول مراجعة تنميتها الاقتصادية وسياساتها التشريعية وإدراج النزعة الإنسانية للتعامل مع هذه القضية بما يتماشى مع المعايير والاتفاقيات والبروتوكولات الدولية التي تهدف إلى التوصل إلى معالجة فعالة شاملة بمشاركة جميع الجهات الفاعلة في هذا المجال. Some societies are experiencing serious patterns of migration. The horrors and rising rates of recurrent marine disasters reflect the depth of this issue, namely, illegal migration, in its humanitarian and security dimensions. it has become a prominent place in the relationship between developed and other developing countries, Given its association with many political, economic and social aspects. It is also the most serious social issue that continues to plague the international community. This has led countries to seek ways to fight and reduce it through the development of many strategies and security mechanisms, and even social policies to achieve this goal. It is often dealt with this phenomenon of migration as a police security administrative file away from social, psychological disciplines, and its treatment was within general policies which keep the file closed within security services and away from civil society and relevant organizations in the field of awareness. Treatment and solutions require States to review their economic development, legislative policies and the inclusion of humanism to deal with this issue in line with the international standards and conventions and protocols aiming to reach a comprehensive effective treatment with the involvement of all actors in this field.
