الملخص

تعتبر الصفقات العمومية من اهم الوسائل القانونية الفعالة والناجعة في انجاز وتنفيذ المشاريع ذات البعد الاستراتيجي في مختلف المجالات الماسة باقتصاد الدول ، لهذا نجد في هذا الصدد اشكالية تحديد مفهوم الصفقة العمومية وفقا لوجود اختلالات معيارية ، وتحديدا فيما يتعلق بمسالة الضبط الدقيق لمفهوم الصفقة من حيث الأطراف وتحديدا المصلحة المتعاقدة في صورة المؤسسة العمومية وبعض الصور القريبة منها ، زد على ذلك اشكالية اخرى متعلقة بموضوعها ، وخاصة ما تعلق بمسالتين مهمتين وهما : الجانب المالي والأسعار المرتبطين بها . الكلمات المفتاحية: المتعامل المتعاقد – المصلحة المتعاقدة – المعيار الشكلي – أسعار الصفقة – سلطة المختصة بتوقيع الصفقة – المعيار المالي . Abstract: Public transactions are considered to be the most effective legal means in the execution and implementation of the economic projects with a strategic dimension in various areas of the countries , For this we find the following problematic: Define the concept of public transaction according to the existence of standard imbalances. In particular the question of strict control of the transaction in terms of parties , in particular the contracting interest in the form of the public institution and some cases close to it. Moreover, there is another problem related to its subject, especially regarding two important issues: the financial aspect and the associated prices.
