الملخص
تعتبر ظاهرة الفساد الإداري والمالي، التي اجتاحت الإدارات العمومية الجزائرية في آدائها لكافة المعاملات الإدارية، السبب الرئيسي وراء توجه الدولة نحو البحث عن آليات يمكن من خلالها مكافحة هذه الظاهرة، التقليل أو الحد منها، وهو ما يبرر التوجه نحو الرقمنة، والتعامل اللامادي خاصة في إبرام الصفقات العمومية، باعتبارها الصورة التي برز فيها تبديد المال العام بشكل واضح، وذلك من خلال البوابة الالكترونية للصفقة العمومية، وهو ما سنقوم بدراسته في هذه الورقة البحثية خاصة في ظل المستجدات التي جاء بها المرسوم الرئاسي رقم 15/247، والتعرف على كافة الأطر المعرفية والقانونية لعملية التعاقد عبر ها . the phenomenon of administrative and financial corruption, which invaded the Algerian public administrations in their performance for all administration transactions , is regarded to be the chief reason behind The state has sought to explore the mechanisms that may fight this phenomenon (lessening or limiting it), and that was justified by the trend toward digitalization, and non –material dealing specially in making public transactions which are considered as the image for squandering the public money quite clearly, and that through the electronic gateway of the public deals .This latter will be studied within the present research paper, especially in the light of the recent updates issued under the Presidential Decree No. 15/247, in addition to identifying all the cognitive and legal frameworks for the contracting process through it .
