التجديد في نظرية الاستحسان

الملخص
تناول هذا البحث أصلا عظيما من أصول الشريعة، وهو أصل الاستحسان، وهو من الشوامخ الخلافية في المباحث الأصولية؛ فكل عنصر من عناصره محفوف بأنظار متباينة، ففي معناه أقوال، وفي تقاسيمه تضطرب الأنواع، لكن الباحث الناظر الفاحص يرى مدى ارتباطه بالمصالح الشرعية. وهذه الدراسة تتناول نظرية الاستحسان: بمفهومها التجديدي، فبعد بيان الأقوال الأصولية في حقيقة الاستحسان، يتبين اتفاقهم على معنى واحد له باعتباره نظرية قائمة بذاتها في مفهومه الكلي، وذلك أن جوهره يتمثل في كونه استثناء من أصل عام لمصلحة اقتضت هذا الاستثناء، كما يتضح أن كل أنواع الاستحسان مردها إلى دليل واحد وهو المصلحة، التي تعتبر المقصد العام من تشريع الأحكام. This study treats the principle of discretion: one of the fundamentals of sharai (the canomical law of Islam). It is one of the most controversial branches of the fundamentalist madhhab. Each of its components is fraught with different perspectives. It means words, and in its classification the species are confused. This study deals with the theory of approval: in its innovative concept, after the statement of fundamentalist statements in the fact of approval, their agreement on one meaning as a stand-alone theory in the concept of the total, and that the essence is an exception from the general interest that necessitated this exception, Types of approbation are due to one guide which is the interest, which is the general purpose of legislating the judgments
