الملخص
ملخّص: يتميز الضرر البيئي بجملة من الخصائص تفتك بالبيئة بصورة يصعب على المتضررين تحديد المسؤول عن الآثار التي يخلفها ذلك الضرر. وبالتالي، نهدف من خلال هذه الورقة البحثية إلى بيان هذه الخصائص، وكذا الآثار التي تخلفها على قرارات القاضي الإداري لتقرير المسؤولية الإدارية لجبر الضرر، ونبين مدى انسجام المنازعة البيئية مع الشروط العامة للتقاضي، في القانون الجزائري. وتوصلنا إلى جملة من النتائج، تتمحور في عدم تطرق المشرع الجزائري في قانون الإجراءات المدنية والإدارية لهذه المسألة ذات الأهمية البالغة، واكتفى بتحديد صاحب الصفة في التقاضي وحصرها في الجمعيات دون سواها. Abstract : The characteristics of environmental harm are numerous; they prevent affected people to determin the responsible for its effects. Through this research, we try to present these characteristics, as well as the implications of the decisions of the administrative judge, and to extent the environmental conflict is compatible with the general conditions of the litigation under Algerian law. We have reached a number of results, focusing on the fact that the Algerian legislator, no moment did the deal with this important subject in the civil and administratives procedures law, and limited the determination of the person in charge of litigation and restricting them to associations.
