إصلاح الأحداث المحبوسين في ظل السياسة الجنائية الحديثة

الملخص
ملخص يعد جنوح الأحداث ظاهرة اجتماعية خطيرة، تمس بالطاقات البشرية وتهدد الاقتصاد، ونظرا لما لها من مميزات فقد اتجهت التشريعات المعاصرة لمواجهتها عن طريق النظم العقابية المختلفة، وفي هذا الإطار اعتمد التشريع الجزائري سياسة إصلاحية تنفذ في ظل مؤسسات تتلاءم مع طبيعة الأحداث وتعمل على تحقيق علاج فعلي ناجع لهم، وذلك من خلال القانون05/04 المؤرخ في 06/02/2005 والمتعلق بتنظيم السجون وإعادة الإدماج الاجتماعي للمساجين، معتمدا في ذلك على أسلوبين، أسلوب الإصلاح في الوسط المغلق بتطبيق السبل التربوية والتهذيبية ضمن المؤسسات الإصلاحية للأحداث، وأسلوب الإصلاح في الوسط المفتوح بإدماج الأحداث في وسطهم الطبيعي. Résumé La délinquance juvénile est un phénomène complexe, lié au développement de la société urbaine et industrielle. En raison des caractéristiques distinctives de cette catégorie, la législation algérienne comme toutes les législations récentes, a adopté une politique pénitentiaire spéciale qui s’exerçait au sein des établissements compatibles avec la nature des mineurs délinquants. En vertu de la loi n° 04-05 du 06-02-2005 relative à l’organisation pénitentiaire et la réinsertion sociale des détenus, deux systèmes pénitentiaires ont été adoptés, l’éducation correctionnelle des mineurs en milieu fermé, et la réhabilitation sociale des mineurs en milieu ouvert. Abstract Juvenile delinquency is one of the most serious problems in society, which is a byproduct of modern urbanization and industrialization, and because of the distinctive characteristics of this category Algerian law as all recent legislations, adopted a special penitentiary policy that was applied within institutions compatible with the nature of juvenile offenders, according to Law N° 04l05 of 06l02l2005 on prison organization and social reintegration of prisoners, which has developed two penitentiary systems, correctional education of minors to the closed environment, and the social rehabilitation of minors in open environment.
