التدابير الوقائية والتدخلية للبلدية في مجال حماية البيئة

الملخص
يخوّل القانون للبلديات في الجزائر جملة من الصلاحيات في مجال حماية البيئة، منها اتخاذ كل التدابير الوقائية والتدخلية لصيانة العناصر المكونة للبيئة، والمحافظة على التوازن البيئي، على اعتبار أن البلدية مكوّن مفصلي في الأجهزة المكلفة بحماية البيئة. غير أن الواقع يؤكد تعاظم التدهور البيئي المحلي واستمراره، مما يثير التساؤلات بشأن هذا الدور، ومدى فعاليته، وبدائل تفعيله . Abstract The law authorizes municipalities in Algeria a number of powers in the field of environmental protection, such as the taking of all preventive measures. interventions for the maintenance of the components of the environment, and maintaining the ecological balance, on the grounds that the municipality is a key component of the systems charged with protecting the environment, though the reality shows the growing and continuity of environmental degradation on a local level, which raises questions about its role and effectiveness, and alternatives to its activation. Résumé La loi autorise les municipalités en Algérie à un certain nombre de compétences dans le domaine de la protection de l'environnement, tel que la prise de toutes les mesures préventives et les interventions pour l'entretien des composantes de l'environnement, et la maintenance de l'équilibre écologique, au motif que la municipalité est une clé composante des systèmes chargés de protéger l'environnement. Mais, la réalité montre la continuité et la croissance de la dégradation de l'environnement au niveau local, ce qui soulève des questions au sujet de son rôle, de son efficacité, et des alternatives de son activation.
