الأحكام القانونية لترحيل المهاجرين غير الشرعيين

الملخص
ملخص: مـن المتفـق عليـه أن الهجرة غير الشرعية بوصفها ظاهرة اجتماعية مستمرة وطبيعية لها علاقة بمبدأ السيادة التي تعتبر تعبيرا صريحا عن الصـراع بـين منطقـين، الأول يــرتبط بــالفرد وهــو منطــق التمتع بحرياتـه وحقوقـه كالحق في التنقل، والثــاني يــرتبط بمنطــق سيادة الدولة على اقليمها وحقهــا في المحافظة على أمــنها وذلك من خلال ضــبط حركــة تنقل المهاجرين غير الشرعيين عبر الحدود من أجل الحفاظ على أمنها وأمن مواطنيها، ومن أجل التوفيق بين حق الفرد وسيادة الدولة، تعمل على ترحيل المهاجرين غير الشرعيين وذلك دون المساس بحقوقهم المكفول في المواثيق الدولية والتشريعات الداخلية. والجزائر وعلى غرار دول العالم تواجه ظاهرة الهجرة غير الشرعية باتخاذ اجراءات قانونية في إطار واجباتها الدولية في إطار حماية للمواطنين الجزائريين والأجانب المقيمين، وذلك بترحيل عدد من المهاجرين غير الشرعيين نحو حدود بلدانهم وذلك بتسهيل عمليات الترحيل في ظروف إنسانية. Abstract: It is agreed that illegal migration as a continuous and natural social phenomenon has to do with the principal of sovereignty, which Express explicit the conflict between two regions. The first is related to the individual which is the logic of enjoyment of his freedom and his rights, such as the right to movement. The second is related to the logic of state sovereignty over its territory and its right in maintaining its security by controlling the movement of migrants across the border to protect its security and the one of its citizens, and in order to reconcile between the right of the individual and the sovereignty of the state.it works to deport illegal immigrants without prejudice to their rights which is guaranteed in international convenient and internal legislation. Algeria, libe the rest of the world , is facing the phenomenon of illegal immigration by taking legal measures within the duty of its international obligation by protecting Algerian citizen and foreign residents by deporting illegal immigrants to their country borders by facilitating deportation in humanitarian conditions.
