الملخص
ملخص: إن العصر الحديث قد استحدث طرقا جديدة في الاستيلاد ومنها طريقة الرحم البديل، وهي أن تحمل امرأة وتنجب نيابة عن امرأة أخرى، حيث أثارت هذه العملية جدلا واسعا لخطورة ما ينتج عنها من هدم للأساس الذي أقيم عليه بناء قواعد النسب، والتي أصبحت موزعة على أكثر من شخص بالإضافة إلى تجزئة مدة الحمل ولكل مرحلة آثارها القانونية، ومن هنا طرحت قضية تأجير الأرحام على الصعيدين الفقهي والقانوني لبيان علاج للأثار المترتبة عليها. Abstract: The modern era has developed new ways of human reproduction, including the substitute womb method which means that a woman bears and gives birth on behalf of another. This process raised a wide controversy because of its risk which may contributes in the destruction of the basis on which the rules of kinship are built on. This rules have become, in effect, distributed on more than one person, in addition to the partition in the duration of pregnancy, as for each stage of it, there is its legal effects. Hence, the issue of wombs rental is raised both on religious juristic and legal levels to show the treatment of the consequent effects.
