الضمانات الدولية والإقليمية لمكافحة العنف ضد المرأة

الملخص
ملخص يشكل العنف ضد المرأة انتهاكاً صارخاً لحقوق الإنسان خاصة ونحن في عصر التنظيم الدولي بما توفره اتفاقيات حقوق الإنسان من ضمانات قانونية على المستويين الداخلي والدولي، بالإضافة إلى الإعلانات الصادرة عن الأمم المتحدة، كما تم تشكيل لجان دولية لرصد أوضاعها وإنشاء آليات من أجلها لتطبيق الحقوق الإنسانية للمرأة، كما أفردت الاتفاقيات الإقليمية بعض نصوصها لمناهضة العنف ضد المرأة، وتعتبر الاتفاقية الأمريكية المثال الأبرز لمناهضة العنف كونها تعتمد الجانب الوقائي والعلاجي في ذات الوقت تليها الإعلانات العربية والميثاق الإفريقي، حيث أكدت هذه الاتفاقيات على حماية المرأة من العنف من خلال آليات ذات طابع مؤسسي وتشريعي وحثت الدول الأطراف في تلك الاتفاقيات على تحيين تشريعاتها الوطنية وفق ما تنص عليه الاتفاقيات الدولية، وأخيراً مكافحة العنف ضد المرأة عن طريق الرقابة والإشراف على تفعيل متابعة إعمال الدول للتدابير التي تضمن مكافحة العنف ضد المرأة على أرض الواقع. ومن أهم التوصيات التي خرجت بها الدراسة ضرورة إقامة جهاز دولي، يسهر على مناهضة العنف ضد المرأة، بالاعتماد على معايير حديثة وثابتة تعتمد على الجانب الوقائي أكثر من الردعي. Abstract: Violence against women constitutes a flagrant violation of human rights, especially in the age of international organization, with the international and international legal guarantees provided by human rights conventions, as well as declarations by the United Nations. International committees have been established to monitor their situation and establish mechanisms to implement women's human rights, And the regional conventions singled out some of its provisions to combat violence against women. The American Convention is the most prominent example of combating violence because it depends on the preventive and therapeutic side at the same time followed by the Arab declarations and the African Charter. To protect women from violence through mechanisms of an institutional and legislative nature and urged States parties to those conventions to modernize their national legislation in accordance with international conventions and, finally, to combat violence against women by controlling and monitoring the implementation of measures to ensure violence against women In reality. One of the most important recommendations of the study is the need to establish an international body to combat violence against women, based on modern and consistent standards that rely on preventive rather than deterrent.
