حالة الضرورة في عمليات نقل وزراعة الاعضاء البشرية (دراسة مقارنة بين الشريعة وقانون الصحة الجزائري الجديد)

الملخص
أقرت الشريعة الاسلامية أسس شرعية لعمليات نقل وزراعة الاعضاء البشرية وهي حالة الضرورة التي يتوجب أن تتوافر على شروط شرعية وأخرى قانونية ، يجب أن يتقيد بها الطبيب ويوازن فيها بين مصلحة المريض الذي يكون مهددا بخطر وشيك ومصلحة المتبرع السليم جسديا بعد موافقته ورضاه دون أي إكراه وتبصيره بمخاطر عملية نقل وزراعة الاعضاء البشرية. ورغم الجدل الفقهي والقانوني حول شرعية هذه العمليات لما فيها من مساس بحرمة جسم الانسان، إلا أنه تم الاتفاق أن هناك أسس شرعية يجب التقيد بها للنقل وزراعة الاعضاء البشرية بين الاحياء أو من الأموات إلى الأحياء ، وتم تقرير وضبط شروط حالة الضرورة التي تفرض التدخل الجراحي لعملية نقل وزراعة الاعضاء البشرية وتقرير الموازنة بين حق الانسان المريض في الحياة وحق السلامة الجسدية للمتبرع من خلال فرض تطبيق الشروط الصارمة لتحقق حالة الضرورة بما يراعي مصلحة المريض والمتبرع ودون المساس بحقوقهم المقررة والمحمية شرعا وقانونا.
