الملخص

تعتبر الطفولة من أبرز مراحل عمر الإنسان لأنها تعد بمثابة الأساس الذي تقوم عليه بناء شخصيته في جميع النواحي العقلية والاجتماعية والبدنية، فهي الفترة الحاسمة في تكوين شخصية الإنسان إضافة إلى ذلك تعد أضعف مرحلة التي يحتاج فيها الشخص إلى المساعدة. إن الاستثمار الفعلي والتنمية الحقيقية في أي مجتمع من المجتمعات تكمن في تنمية أبنائه وكون عنصر الحسم في الصراع الحضاري بين الأمم والشعوب يكمن في جوهره في العنصر البشري وبما يتوافر له من فرص التنشئة السليمة والتربية والتعليم، هي الوسيلة المثلى لمواجهة التحديات الحضارية بتشكيل وإعداد جيل جديد له الوعي والتفكير العلمي والمعرفي والمهارات اللازمة. تهدف هذه الدراسة إلى إجلاء الصورة عن حقوق أطفالنا خاصة إذا ما قارنا ذلك بالجانب العملي الواقعي حيث نجد أطفالنا مقهورين ومنتهكة حقوقهم العامة والخاصة في العديد من المناطق، وبالتالي نسعى للوقوف على آليات حماية هذه الفئة المستضعفة التي تولت العديد من المنظمات والهيئات كفالة حقوقه وحمايتها. ولمعالجة هذا الموضوع انطلقنا من تساؤلين هامين في الإشكالية: ما هي أهم الحقوق التي يجب مراعاتها بشأن الأطفال، ما هي الوسائل والهيئات التي تتولى كفالة هذه الحقوق وفق أحكام القانون الدولي Abstract: Childhood is considered one of the most important stages in human life, because it serves as the basis for building personality in all aspects of mental, social and physical. Human personality is formed in the crucial period. It is obvious that the actual investment and development in any society is in the development of children and that the element of decisiveness in the civilizational conflict between nations and peoples lies in its essence in the human element and in the opportunities of sound upbringing, education and knowledge is the best way to confront the civilizational challenges. New awareness, scientific and cognitive thinking and skills are needed. This study aims to promote the image of the rights of our children, especially if we compare this with the real practical aspect, where we find our children oppressed and victims of violation from their public and private rights in many areas, and thus we seek to find mechanisms to protect this vulnerable group.In order to address this issue, two important questions have arisen: What are the most important rights to be observed in regard to children? What are the means and bodies that guarantee these rights in accordance with the provisions of international law? Résumé : L’enfance est considérée comme l’une des étapes les plus importantes de la vie humaine, car elle sert de base à l’édification de la personnalité dans tous les aspects, mental, social et physique, c’est la période cruciale de la formation de la personnalité humaine. Il est évident que l’investissement et le développement réels de toute société reposent sur le développement de ses enfants et que le facteur de décision dans le conflit de civilisation entre nations et peuples réside dans son essence et que les possibilités offertes par une socialisation, une éducation et un enseignement solides constituent le meilleur moyen de relever les défis de la civilisation. Une nouvelle prise de conscience, une pensée scientifique et cognitive et des compétences sont nécessaires. Cette étude a pour objectif de promouvoir l’image des droits de nos enfants, en particulier si nous comparons cet aspect à la réalité pratique, où nos enfants sont opprimés et privés de leurs droits publics et privés dans de nombreux domaines. Nous cherchons donc à trouver des mécanismes pour protéger ce groupe vulnérable. Afin de résoudre ce problème, deux questions importantes ont été soulevées : Quels sont les droits les plus importants à respecter en ce qui concerne les enfants ? Quels sont les moyens et les organes qui garantissent ces droits conformément aux dispositions du droit international ?
